Mississippi Could Legalize Discrimination Against People Who Have Premarital Sex | AlterNet (see my comment to article.)The human rights legal issue of Roe V Wade has less to do with abortion than it does with the right for adults privacy rights as I was taught be one who had practiced before the US Supreme Court.( I am not a lawyer.). Something that has long been forgotten in all the issues of the unborn being another life involved in the case that usually is only thought of a the case to make abortion legal .
Its a deep and hard issue to ponder and a current presidential candidate got stuck in the mud of what the rest of society has been mired in since 1973 and the stigmas of society has had us stuck I for thousands of years. I have a background in faith and public policy advocacy and part of my seminary training was to study and ponder and figure out what I BELIEVED as an individual , not just what the teachings of a faith or church doctrine might say. Maybe we need a check list for politicians of the issues they need to sit down and ponder before they walk into the public arena and get asked and be unprepared as to how they would answer based on their personal beliefs. Rights of privacy with Roe v Wade as the underpinning court case for most laws and court cases since 1973 is GOING TO BE RAISED as its still SPLITTING THE NATION ASUNDER. Ad what you want to do for economy, immigration or going to war and against whom, all comes back to a life issue and one court case that has never fully answered all the issues for us. We became Pro Life or Pro Choice, not CHOOSE LIFE which opens us up to making LIFE THE EASIER CHOICE.
IF SOCIETY TRULY SUPPORTS THE ONE HAVING TO MAKE A CHOICE OF THE MOST PERSONAL NATURE THAT AFFECTS TWO LIVES AS MANY DO BELIEVE IT DOES AND WHAT SOCIETY NOW MAY BE ABLE TO DO WITH AN UNWANTED UNBORN THAT SCIENCE NOW SAYS CAN LIVE IF WE, AS A SOCIETY, WISH TO CHOOSE FOR IT BE. And so far, we have not dealt with this well, as we have gone done a path of LESS RIGHTS FOR THOSE BORN ALREADY in less health care, and support for each other to have a hand up to become independently self sufficient so we can each be free to live our lives. without fears of loss of life and basics of survival. The FREE LABOR OF MACHINES WAS AND STILL CAN BE FOR EACH OF US AND STILL PROVIDE A FAIR COMPENSATION FOR INVENTORS AND OWNERS OF THEM.
. As a society , we should have had a different kind of case to make the underpinning equal rights case in the USA. As all of our civil rights cases, use Roe V Wade as the foundation for those laws.
The legal premise as I was taught was that once the action is taken it can not be redone to make it it constitutionally right. So abortion became the ultimate issue for once the baby is dead, it cannot be undone by humans in this lifetime.
Somehow the courts never zeroed in on the issue of two lives involved and what of the unborn life.
And as we learn more scientifically its blatantly clear, that a baby can develop and grow OUTSIDE OF THE MOTHER. That in itself should set aside Roe V wade and use another case which does not raise the issue of two lives involved as the basic Civil Rights case. like Moore V. Cleveland where a grandmother lost her right to subsidized housing and a place to live if or when she let her grandchild give with her as that was forbidden. Is the understanding I had of that case. Again , after the time has passed there was not way to turn back time so that the two could remain in the housing . Money can be awarded for damages, but when ones privacy rights of family and life affected is involved , it cannot be made fully right ever.
As I and the courts should have considered, Roe V Wade was a poor choice for issues of privacy and freedom of choice.BUT THE DEVIL IS A SNEAK and this nation has been split ever since and we have ended in wars and other atrocities as we voted for candidates on the side they took on this one issue.
The privacy issue is whether any one else , or the government has the right to tell anyone what they can do with the most private part of life, ones own body. It does go beyond property rights or invasion of privacy in ones own home , etc. And abortion became the case, used to preserve what was a good thing constitutionally, but the sacrifice of the unborn gave us the new rights. Now maybe all can have the rights of life?
Its a hard and very foundational issue. And in the years when Roe V Wade went through the courts, there were terrible stigmas against an unwed mother, and choices or rights of pregnant women were often non existent. Society did not support life, unborn life at all. in many ways.
Now, times have changed so that discrimination is not so severe and we allow others to live their lives with out moral indignation, and no understandings of situations women can be in that are part of natural life and or circumstances beyond their control such as economics for survival. NO WOMAN SHOULD EVER HAVE HAD TO CHOOSE ABORTION FOR ECONOMIC REASONS OR A SOCIETY THAT HAD MORAL INDIGNATION OF ONE WHO WAS NOT MARRIED.
Or the pregnant couple be interracial. Which the horror of the attack on the president's young parents was due to racial hatreds that should never be in a society that often praise itself as one based on principles of love and mercy of the major religion of the nation, Christianity.
As a Christian , I could never begin to imagine Christ ever treating a pregnant woman as society did for thousands of years, f anything it was the teaching and example of Christ that began the process in human history for equal rights for women. which we do not yet quite have.
When one studies the early history of Christianity, one is often shocked to know how much women were part of the early ministry of the early church. somehow, in becoming a one world religion under Constantine, women's rights and equality in matters of faith got squelched and stayed that way in society which was under the church state. and when a woman became 'unpure' before marriage or was an unwed mother, the stigma imposed by the teachings of a one world religion parted ways BIG TIME with the teachings of Christ. Where love and mercy and compassion and each individual being loved and special in HIS eyes was case aside and stigmas imposed on women and children not born in wedlock.
Its why President Obama's grandparents were so desperate to either her give the baby up for adoption to be raised within a marriage. Or find her a husband , even if in name only to relieve any stigma of society that was anything but CHRISTIAN. and the anti-Christian hatreds of racism on top of that. And my dad, Rev. Tracy Hardy , went along with performing a marriage for the sake of the child as well as his mother, his great niece. to TAKE AWAY THE UNCHRISTIAN STIGMA OF A SOCIETY THAT HAD LOST THE TEACHINGS OF CHRIST IN MANY WAYS.
I mention Christianity as its a fact of history and the same was the similar in areas of the world with other religions being the major religion of the area. The arrangement was never for them to be husband and wife in the Biblical sense, and they did not live together that I was ever aware of. They came together for him to be in the USA AND FOR HIM TO AGREE TO GIVE THE BABY HIS NAME AS A FAVOR TO HER DAD WHO WAS IN AFRICA AT THE TIME ON DUTY WITH THE MILITARY. Duties that always seemed to be very secretive.
TIMES HAVE CHANGED AND SCIENCE HAS GROWN
Yet we are still caught in the old argument on privacy rights of use of ones own body with ROE V WADE as the court case. And we try o limit abortion by the times the baby can live outside the womb in the traditional sense, NOT BY WHAT MODERN SCIENCE CAN REALLY DO , if we choose to apply it? And the stigma to the mother has been removed legally if not morally more acceptable by social norms.
And we are still working on a better support network economically for the mother and baby, at times we do better than others. But the end result of Roe V Wade is for none be told how many children one can have, or if one is old that they should die quietly as a burden to society All issues that have surfaced since that one case, never really got to the bigger issues that maybe we can not get to as a society and not be split so , when all came come to where no life, born or unborn has to be ended before ones natural time. Society can now CHOOSE LIFE for one not wanted by ones own? I raise the issues....
BOTTOM LINE
Maybe its time to revisit Roe V Wade in light of the new science and new norms of society. And if a woman does not wish to have a baby for 9 months inside her body, then society needs to take responsibility for the unborn just as they would for one already born that is not wanted.
We have Constitution which is our governing document that is a living document. and the interpretations of our laws and court decisions that interpret what is constitutional can evolve as society learns ad understands things more fully. WE ARE NOT LOCKED INTO THE PAST DECISIONS as we are still a nation governed by it. Unlike the laws of Moses who was the SUPREME COURT of lower judges decisions. that could not evolve as the nation went under a Monarchy and locked itself in to the past. not that much in those are not good law. But as society learned and understood more , they could not change until CHRIST CAME AND BEGAN TO TEACH THEM THAT THEY WERE NOT LOCKED INTO THE PAST, BUT COULD CHANGE LAWS AS SOCIETY LEARNS MORE OF WHAT IS RIGHT, GOOD AND REPRESENTS MORE CLOSELY WHAT OUR CREATOR WAS LIKE AND WANTED US TO BE LIKE IN HOW WE TREATED EACH OTHER IN SOCIETY. Even those with no faith, can be led by common wisdom to understand this as what is best for one, is best for society that can be FREE TO LEARN AND BE BETTER FOR EACH AND ALL TO ALL BE FREE AND JUSTICE BE FOR EACH AND ALL.
We are not locked into the past as we have not changed the method of governing. New understandings of the truth and new knowledge gives us more possible options AND MORE CHOICES TO HOW TO CHOOSE LIFE OVER DEATH as an individual, or collectively as a society. Both of which are respected under out constitution, with individual as higher.
I am one that has always understood the terrible conundrum of ROE V WADE where the life of the unborn got cast aside weighed against the civil and privacy rights of each of us. TIME TO THINK THROUGH THIS LEGALLY IN NEW WAYS AS WE HAVE NEW SOCIETAL NORMS AND NEW SCIENCE FOR DIFFERENT THAN IN 1973/ This nation has been torn asunder far too long over one issue and we have elected some who have cost this nations dearly in adult lives and other rights as we focused on the one issue only. which is crucial for justice or all. But it was too easy for a candidate to say they were pro- choice or pro life and then govern in ways that did not reflect either.
JUSTICE DENIED ONE DENIES IT TO ALL IN TIME ......
Time for some new thoughts on a VERY SERIOUS MATTER OF LIFE FOR ALL BORN AND UNBORN.THIS IS NOT APRIL FOOL'S JOKE BUT A MATTER OF LIFE AND DEATH FOR EACH. Something that for most comes right to our doorstep when least expected as life is like that and so it is for a presidential candidate who gets asked in front of the whole world.
