As well as she did not seem to understand HR 1063 for the recovery law under Medicare at all. Since ACS has been 'taking care of all of that for all the Part D insurance plans and now all the insurance companies including AARP owe 6 years of monies ill gotten back to Medicare for paying claims primary that were not Medicare's primary responsibility.
As we found out from management at ACS in charge of paying all of these claims; the ACS management has never sent any claims to be recovered on any one in 6 years and did not know they needed to do so. ACS has every Health Plan insurer in trouble as they can say WE WERE NEVER TOLD THESE CLAIMS WERE TO BE A CONDITIONAL PAYMENT AND HOW TO HANDLE THEM BY THE HEALTH INSURANCE COMPANIES THAT ALSO SOLD ALL THOSE PART D POLICIES AND AS WE FOUND OUT SOLD OR NOT SOLD POLICIES TO ALL THOSE COVERED UNDER THE FEDERAL HEALTH INSURANCE PLANS WITH OUT BEING ABLE TO SAY WHAT THE COVERAGE WAS. We now know its works like part A and B of Medicare and we should all have been paying $0 and no co pay when all of the claims have been paid entirely by Medicare and the insurance companies all GOT AN ILLEGAL BAIL OUT FROM THE FEDS BY HIRING ACS TO PROCESS THER CLAIMS.
