Through my 'net-working' with other injured federal workers et al, it seesm clear that something is criminally wrong at the London, Ky ACS-Xerox site. and has been from the very moment Affilated Oomputer Servcies headquarted in Dallas, Tx a Deleware Corporation now owned by Xerox took over nt long after 9/11/01. Their job is to set up files, post and NOT BE DECIDER OF FACTS OR OUTCOMES.Who gave them this extra-legal authority, someones 'wild' interpretation of some obscure portion of that 'notorous' Patriot Act?
Its the only address any can submit items to , even judges rulings go there first and some inside the US Dept of Labor even think its a US Dept of Labor office as that is on theeletter head. Federal law says? that it shoudl read US Dept of Labor % ACS govt contractor or some such so one knows who is getting the mailing. Even the recovery unit at Medicare contractor did not know ACS was ignoring their efforts and was the entity not the govt telling them "nothing to do".
Nothing can be submitted to any US Dept of Labor office with regard to Federal Workers Comp as Lodon Ky ACS has to get it first before its posted and then can be officially worked.Even if I hand carried the judges orders to my claims examiner, she could not act.
In 2001, it was decided that no govt official could be 'trusted' with govt files. Even With all the security ciearances they have, audit controls and subject to arrest if do crimes? No, it goes to a govt contractor interlocked with almsot all of them throughout the govt and where there is no internal audit control, and no monies to spend to prosecute crimes committd? States have been deaing with them too Medicaid claims, too..
Seems that the criminal investigation that finally did start occurring back then, led to another cover up rather than ferreting out the high level few bad apples and making sure no more of them could ever commit such crimes as before. I am in this mess due to a riffling/destruction of my file before ACS ever took over in the Dallas Office . And that was not the first time. And its been in every agency of both digital or paper files that have eitther been messed with/ disappeared or hacked into. And all reported to OIG's and all say policy is to do nothing about security in ther own offices and entities.ON ANY ones files, not just mine. Director of OIG said that to me at US Dept of Labor several yaars ago,so this has been going on through several presidents now. Federal documents going missing ib a 25 year pattern of criminal behavior is NOT a national security problem? Just who is Homeland Security supposed to be protecting? If not our basic rights to legally submit 'petitions or claims to our govt and have even the formal rulings and orders from judges, to not disappear, also? Even personnel and cliams files at Social Security and system hacked into and that includes the records of everyone who has ever had an SSN or claim. Not even Deputy Comm of SSA can get this investigated. If it ever gets done, who knows what 'truth' about the SSN its alleged the President is using might ucover? So who is in charge in this govt of ours?
THUS ACS IS NOW THE DETERMIMER OF FACT AT ALL LEVELS AS THEY CONTROL WHAT DOES GET POSTED TO BE SEEN. By any one who is to take official action.One can't obey a judge if the orders can't be seen which has occurred with me multiple times.Plus the files reconstructed for the judges disappeared also. And my SSA Hearing file 'walked out' of the McAlestar, OK Hearing office never to be seen again after they were to post it. I was told months later when I followed up to find how much longer before a hearing would be. This has ended with real retaliation towards me for this getting out of their responsiblity for security of the file in that office and certain parties in the regional office. And to this day no official transfer signed by any judge there which is legally requried. Matters got worse as a few papers sent to put in the file later on resulted in only those being looked at and dismissed with out a hearing and the judge not 'officially' knowing he had an entire file and hearing and issues egally and properly before him, That caused years delay and the remand order from the apppelate judge has been 'disappeared' also. No one knows anything about it. YET: ITS legally pending since 8/09 in that office although they don't have it and my repeated efforts from my own employer has been met with 'cover-up' responses and phone slammed in my ear. And talking is very painful as it requires deeper breathing and I have not been able to take a deeper breath wthout bronchiospasm and other chest pains since 1/10/89 -- Inhalation of toxic fumes with bronchiospasm accepted by Federal workers comp back in 1989. Occuapitonsl asthma diesses claim and other medical issues later on, too. all as of 1/10/89.
Plus I have been told of the intentinoal malicious 'gossip' is atrocious through out and person even sent me ccpies of remarks onn a computer file all have access to. SSA is not to be doing this at all. Its not only illegal, but our signed agreement in my pernsonnel file apparently has diasppeared along with the file itself at ACS?Along with the same phrase repeated "Nothng to do on my file." A direct quote from CEO Lynn Blodgett accoring to a letter.. .SSA also has a file alomst 25 years old; but has no idea it is plus my medicals and even the consulting pulmnologists rreport went missing too (8 times) and they have no idea what occurred which was a crime(e) acmmitted by a former Acting Comm of SSA, according g to stste witnesses. So when its alleged something criminal has occurrred at SSA with Pres Obama's records, then one might look at the highests levels...
Now there is a 25 year back log , also at US Dept of Labor on my workers claims file of some items processed, paid, and other actions on secondary/tertiary medical issues and worse is that what did get paid in the Dallas region was not itemized to know for sure what was or was not paid or the exact amount. It was done correctly in other regional offices of wht they ddi get paid before the files disappared again. Even a Hearing officer ordered Dallas in 199 to change and rpocess things l ina elgal manner. Did not do so and in 2005 when they used the system, paprt form ACS to pay abou t $10,000 of traval expenses its a mess to see what is was or was not paid, etc .Bascally requires a total reworking of those to subtract what is to be paid from the total paid amount can't quite figure out was it was for. And the BILL PAY PRTAL for ACS which I can see does not show all that was paid either. MORE HIDING THE SEVERITY OF THE INJURY?. Plus all the timely filed appeals ignored on all of this and out of pocket expenses and leave buy back obstructed, an the list goes on leaving me in legal limbo as the request for achedule award and permanent disiability pending since 1996 onp the already accepted conditioa has been pending since 1996 and these peieng issues referred to by even the appellate judges needing aninitial deciosn before they could rule on any appeal.
In the mean time, the two pxygen suppliers i theaea will not ocme as they take ther first orders form ACS and they wil ot ok my life susuataig need. I need toget a defective tank replaced and my life is held together with Krazy glue and Gorilla tape and loved one just came in and lowered it to let liquid oxygen run to the top and rasied it back up so I can live to type this. But with a partial atorphy in a hand due to the medical obstrutions three judges referred to in 2004 from 2002,ABG NEEDLE STICK that scraped the nerves in right hand. and care got delayed to 2007 and too late for an excellent physical therapist to do anything. He showed me .
My file was never set up and learned this directly froom the ACS managers in 2005 and also from Horace M Cooper( now a convicted criminal in the Jack Abramoff birbery scandal) who was Chief of Employment Standards at US Dept of Labor and let the contract to them and relayed from OPM Dirctor? an order to "let her die" which Arkansas Blues had been given but their manager chose to ignore it and paid for oxygen from Lincare while Health Connections continued to be paid by Federal workers ocmp and LIncare bought them out and the date of sale ended the duplicate pays. It was only a few years ago, I learned of this duplication when ACS Bill Portal went onine and found it out, but not everything paid on me is o there Either. ( this is not the file needed to be set up so it can be worked). . ARK Blues soon had the ccntract from FEHB given to Ill Blues for our area which said Medicare should pay first and took back all the money from them to dump onto medicare. But never took back from the other medical providers so something illegal occurred here in a form of collusion? it would seem. And then Iincare wouldn't bill Medicare until claims filed with Workers comp,i.e ACS and they are hiding oxygen use.due to the strict 1988 law to stop this exact kind of abuses when one could die due to them. .
So my life is caught up in some ones tug of war of what? No one will ever tell me why? Don't victims of such abuses get some help to live?No, not if there is n criminal investigation is acknoweldged. But I filed the invoices for payment as a protective filing and no response ever to say it was not a valid protective fling.And or late as I filed it when I learned they had not done so, as they had not even bothered to bill me after Ark Blues had paid. They medcially abandoned me in 2006 as were told by ACS I had a million dollars to pay and where is that? Rhema said they cold not get Lincare to sign over the contract on me and they medically abandoned me after a couple of months, even trying to pull the canal out of my nose and lawyer said 911 and the Chief of Colbert Police said if you do would be arrested for attempted murder if they did and left but never sent in cliams and I field with allthree palns also. All About Mobility did ccome for several years and got paid by Medicare and Blues until Medicare regs forced them out of that business along with al lthe other small ocmpanies in the USA with a reg that makes no medical sense; having to hire a resp tech to deliver a tank.? Medicare's reqeust for their money back is were at ACS? US Dept of Labor has never senen it nor the oxygen claims either. I then filed for enforcment of the conditional pay law and led to M09-1406 and then HR 1063 signed into law 1/11/13 and it should settle all of this as used to do for others under the original one of 1981.that those doing such bad things didn't like and got it suspended from enforcement in 1994 whe Sec of HHS Donna Shalala said the ins industry could 'police itself.' And the collapse of our health care system was well under way as no one paying claims had to 'play by the rules any more and secret deals over ruled laws, regulations, judges orders or govt contract terms. Which are no longer enforced to be obeyed by these entities. .
Horace M Coper told me in 2005 before his job was abolished ( after Sec of Labor got involved to help me reconstrct my file?) that decision had been made I was old and it was not to be posted. Didn't matter about judges orders in file of a lot of work to be done in the file. Soon after Sec Of Labor;s staff made the arragnements with ACS in Tallahasse to use the 1-8800 number to reconstrut the entire 35,000 page file as the one for the appellate judges had 'walked out of the ACS office in London Ky ' never to be seen again in 6/04 and I was not aware of that until a billing lady for the Univerty of Texas called me and said I had permanent medical benefits showing on the system with Federal workers comp and asked if she coudl billthem and I said yes, and they ere paid. but after althis got back to London Ky it all ended.again.....
I had had my file rifled after it came to Dallas from Philadelphia and after I had worked with the Congressonal Committe on Govt Reform to get laws passed so what had aleady occurred on my file and life rights obstrcted would never happen again. to me or any one else I had heard of. No one should ever be sent back to work under those who have committed criminal acts and allowed to get by with it , then turn on the very employee whose medical rcords proved their criminal negligence. Not unless there is back up support.A voc rehab person assigned to go to. And cetaianly more than an easily ignored written okay to very strict accommodatons which for me included , remaoval of chemical barriers and sedentary non exertional work, (never happened)Gas masks and motorized cart was the only means of survival in a public Social Security office. were I inteviewed them like that at my last duty station in Camden NJ after four months of being forced to drive 150 miles a day in a car with no AC in the middle of summer to get to work at the duty station assigned in East Brunswick as Federal workers comp said Jersey City TSC air was unsafe for me to breathe even after vents , etc had been installed. when I tried to work a few months in 4/89 through 8/89 then got called for jury duty in midwest as had not changed residency and had voted absentee in 1988 election. and owcp got my claim approved after HHS reg office had not sent on a big part of it and had to reconstruct it and haad already found out most of the accident reports for the office wre missing too. so crimes never ceased from before we entered on duty 7/88/ to now. and I never returned util 7/90 after my claims examiner in NY office had wanted to put me on permanent disability then in 9/89.I over heard there was to be a grand jury convened and heard I was sent back to work and the testimony was no one badly injured all back to work now and deaths have occurred and most of us will have our injuries cost us our lives prematurely So if there was perjurd testimony , it stands and no one asked me to tetify, nor submit my medical records. ..
The current system still does not support an injured worker returning with strict needs to be met. And tht is something over and above any whistleblower laws. Those currentl laws are meaningless if all the other laws aren't in place to support the continued threate to life and health. And that , too often, concerns criminal acts by the liabiity insurance industry which often never get investigated nor caught with regard to Federwl employees who are put into the unttenable situation of suing entiies bigger than the govts system to contain on behalf of the tax payer and have that obsturcted , also. as those who have commmitted criminal collusion thwart any attempt of the govt to take action on behalf of the taxpayer or the injured worker(s).
Laws, in our system are complex. They are always going to be filled with ifs, ands and buts as all have to be awarded full constitutional rights equal to each other before it. And our laws are aleady complex and a new one must not over lap or obstruct the carrying out of another so other laws may need to be amendned or negated with the new law.
Thsoe humongous bills not geting read before signed, may actually need to be even larger in order for fairness and equality to exist.
HR 1063 is not well understood by those working in the govt entities now, as they never knew about the original conditional payment law that was suspended from being enforced back in 1994. And when the false caims act was passed, it in many ways is in direct conflict as it does not put the onerous on the govt to file suit. on behalf of the taxpayer and the injured workers. who would have right to their own personal counsel to assist.
What we have now, is a collapse of both systems as injured federal workers are rarely ever able to get legal help and even fewer attorneys will take a false claim case for less than tens of millions of dollars. up against an etitiy the govt itself will not take on. Yet we the people, expect our tax dollars to do just that. Take on those wo hae decided that our laws and rights have no meaning. And one soon learns all the big law firms are under contract with this intelocked cabal and can not help.

THIS IS NOT ABOUT ME GETTING BIG MONEY IN A LAW SUIT AT ALL. Often Federsl workers gain little more than ther monthly checks based on modest salary most of us get and medical bills and expenses paid. Its the taxpayer that is gettng reimbursed because their employees the, federal civilianservant went to work and got injured and our laws say they must proceed with claims in order to get medical care and sustain life.. Our system of health insurers, bother private and govt and the Federal Employees group plans all require workers comp car ins or a third party which might be liabl to be be persued or they wllot pay and few federal workers are wealthy and can pay for life long care for themselves. . In my case and others its obvious something went badly wrong for us to be injured. And not an accident but malfesance and/ or criminal acts of varying types occurred or injuries would not have occurred and then there were criminal negligence after the fact also to continually cover up and that got far and wide even to the 9-11 Commission deciding to not look into the matter ( befroe 1995) and more official govt files going missing which I understand were a lot more than my files
When its too easy to cover up wrongs and crimes, then we just go on denying justice it just keeps on festering .like the three dead in the Kansas river in 3/61 in Topeka Ks which has led to the present day 'birther' movement based on a false premise of trying to prove something that does not exist. that Topeka Ks is phsycially in the nation sof Kenya. It affected elections in ways we may never know. And still causes issues to be on- going when we need to be solving our problems with goodlaws that support the "general welfare of the people and the security of hte nation as our Ocnstitution requires. If there are High crimes committed by some then our officials need to address them. But when one goes on a journey for truth and justice we may not know where the path will lead us. or to whom?
