Of course all new laws eventually or they used to be tested for interpretation in fornt of an agency judge or sometimes a courtroom judge. So I can only speak to 45 years of experience in the system of our Federal government which is currently badly broken so bad laws never get a constitutional review and a constitutional interpretation done much any more as govt contractors handle most of the early appeals and they don't have the authority, nor training as to how to deal with such issues.
But the new law which is called the SMART law is designed to provide penalties to all those out there trying to dump other entities' obligations onto medicare. Most would read this thinking it would be a doctor or hospital? Why would they/ They complain now about how much lower the payments are No the bigger problems has been since Sec of HHS Donna Shalala suspcned the enforcement of the Conditional payment law back in 1994 and collapsed the health system in this country as the finagling and game playing began to manipulate claims and the system so the bills could get ' dumped' onto Medicare and never have to be accountable and repay them ever.
What the law signed 1/11/13 does is provide a $1000 a day penalty against those who do not comply with the law. There is an implied meaning to that aw. The patient could end up owng the money for the claim if they do not inform the medical provider that a conditional payment coding is needed. I always put it down and the big billing services ignore it on orders of CMS officials I have been unofficially lobbying Congress and doing everything I could, with the help of Doyle to get this provision put back in place using every means possible to no avail as the corruption is so entrenched even inside the Medicare agency to collude in the the theft of Medicare which is exactly what has been going on. Medicare really is not broke its been swindled because the whole health insurance industry has been permitted to seal and officials in charge have been helping them Appellate Judges have rule and said the patient must sue on behalf of the govt on case M09-1406 which Cigna Govt Services allowed me to get some claims that High asking for the govt to do their job which the 1980's law said they should. Instead, as many do not realize, these appellate decsions can get passed on for legislation that is needed. We do need to give some credit in all this to Don Ber wick M.D. who was appointed for a temporary Directorship of CMS even though the US Senate would not confirm him, because of his political views as he was not considered pro life enough.When the money for health care disappears thorug corruption and health care is not paid for at all, not much pro life in that either, is there? In 2005, MSPRC did go thorug the ntioanl data base and found many cliams andsent letter to ACS, but they ignored them. Trailblazers NEVER referred any claim for recovery.They just turned one claim into 17 and 16 payments for each did not go to the medical provider that I'm aware of.
I have been very careful to make sure every medical provider is aware of OWCP involvement, but then they would be informed to ignore it by the govt contractors they called and so nothing ever got coded for reppayment except the oxygen claims that CGS Medicare paid. and would still be paying except the unconstitutional regulaiton passed 1/08 that forced small home agencies out of a side line compressed air business and left it all to mega, now international ., companies. Thus casuing our son to deliiver and get the tnaks filled by the manufacturer and we pay out of pocket with claims not geiting processed by any although approved for life by all three until 12/11 after I called Sen Inhofe's office and Blues reimburses at 60% and will not recognize any owcp and has not sent any recovery letters from them since 2005 either on orders from?.
In my case, being denied service as a contractor of the contractor at owcp Affiliated computer servcies who is under orders to "let her die' given by "Mr Or Ms OPM" and the former Chief of Employment Standards at US Dept of Lbor who issued the contract to ACS in the first place; who ordered my claims file not be posted because I was old and carried on the order and is now a convicted criminal in the Jack Abramoff bribery scandal that most have ant diea has never been completed and involves SSA, HHS, US Dept of Labor and who knows how many other highleyplalced officials and big money is misisng all over. and in the case of injured federal workers some have died before their time and the statute of limitations should never run out on a felony murder charge. Except one can't murder an injured federal worker as its a civil matter only. In 2014, will it be so for everyone as they run health care through this mega international cabal that is going private having amassed so much money and interlocked themselves financially that no one will ever know who's in charge as rarely is it the CEO who runs things, but the major stock holders behind the scenes which no one will know who they are in a privately held company. Yes they have stolen, skimmedd and gotten so much govt monies around this world they now can buy their publically traded stock back and become a privately held mega company more powerful than any govt on this planet and more powerful. then all of them combined. Is this the Beast of Revelation? I just raise the question as so far what has occurred towards my family and I is not good, but beastly.
BIASED BLUES FORM
The quesitonaire is like the ones filled out periodically from Fed Blues. And it was sent to me and the form does not lead to getting to the situation in our family and others where Medicare is not the primary payer for any and all of us. Since we intend to use this form for any and all parties and entities that need to know who pays first we needed to amend it some.
At he top of the form we annotatedHR1063 SMART Law apples. Then I filled out the first part for me. And listed my claims examiner at Fed workers comp who called me this week and said SHE doesn't have the file after putting down the address of PO Bx 8300, London Ky which is where all paper , even Judges orders have to go before she is allowed to see it and Affiliated computer services and CEO Lynn Blodgett will decide if any one Will ever see it. She prayerfully will be honest when any one calls to verify coverage, that she doesn't know what is going on and tell them to file the claim. But the phone number the billing people has is not hers, but the ACS call center and they get lied to under orders of CEO and the manager said also Mr OR MS OPM, originally Kay Coleman James, a past Directo,r whose orders are still being carried out over a decade later. Former director Linda Springer, personally got involved and began making phone calls to find out what was going on and suddenly resigned in 7/08 to take a job with Earnest and Young one of the two unaccountable govt contractors that got the TARP money to spend and now Congress is still trying to find out what happened to 700 Billion dollars of the people's money after some info surfaced that much of it went to EU Banks for what?
Money that most though would be used to stimulate the USA economy and didn't..
So all the info was put on the forms and showed that family members have medicare and it was secondary to Blues for them. It asked nothing about Medciad as third payer for a loved one on the policy. It asked for each ssn and that;' why? in the past, the form is ignored and they go with the SSN and do as they please. and continue calling Medicare coordination of benefits to have Blues deleted off the system so they can have Medicare pay and that's a penalty under this law. I see nothing in this law that precludes any govt employee or govt contractor or govt health plan or contract as FEHB of any kind from being immune from the penalty. Its illegal, what they have been doing! So any govt official can be held liable for a crime and no one should be going along with theft of Medicare any more. Instead they are to provide the codes needed to override the system to have Medicare pay and it will send the claims on over to Secondary Medicare And Recovery uniT to recover the monies or fines get imposed.
There is some scrambling going on and patients need to be cognizant of providing the info needed to absolve themselves from any default against them.
I also put on the form that Part B is pending and under appeal .Of course the Hearing file is missing out of the hearing office and will the new commissioner of SSA care about security and rights of all? And the request for Part B I filed a year ago goes unprocessed. Apparently ACS has decided they want to cause more trouble and why in the world Comm Astrue gave ACS control of SSA is beyond me. Would have been cheaper to hire some of those Vets coming home, even if a temporary job at SSA and other agencies to do what these contractors are doing for data to leave the agency and then input on a system and may or may not come back to the agency.
Part of the overall coup d'etat? I really am on the 'hit list?" Eye witness to one thing after another all my life that has import and could land too many in jail if ever justice is to be served in this country against the powerful and elite doing such great harm.
So the form was mailed and Doyle made copies to use to hand in with ins info and to any one sending a bill and other filings. Have not seen a form from Medicare yet for each of us. But there is one. There's so much paper work to take care of and beyond what any one with physical disabiilties like me can do or even with Doyle's help doing the more 'stinky' pat of it. And our in home machines are not the real stinky kind like in a modern office, but they take longer to use and have to be in a far part of the home where ventilated, to the outside and its difficult. foor us.
I pray within a few months this all will get resolved or the Rapture comes. But until good over comes evil forever, we must keep on, keep on.
We both signed the form on all pages and Doyle stamped it with the stamp that we bought that shows all three of my claim number in the order of primary to medicare as last. I can't tolerate the stink as an inflaming asthma and pnemonitis trigger. Most of those involved in medical billing I've spoken to in the last month know nothing of this law. This can not be another law passed and signed into law and never carried out. Medicare needs to start getting their money back. Its been the law all along to repay, but there was no penalties to not doing it. Only against doctors or hospitals that might have coded worng and got overpaid, and that's another problems. in my case most are underpaid as the more expensvie charges are the ones for treating my accepted medical conditions at OWCP.

It would if OIG would be doing their job against the govt conractors they advertise they have authority over , yet don't according to a letter I got some time ago and others have said it verbally when assigned to criminally investigiate and found out it was a partner of medicare and were not allowed to do anything.
I agree with much of the laundry list of things that need to be done in this country in the State of The Union Speech. But there are grave concerns in implementation as govt contractors are in total control with no accountability and data bases have so much corrupted and false info in them that even gun control could end up denying rights over false info on the records that can't get corrected. Those medical records on all of us are almost public information among this cabal running this world, now and its not under HIPPAA which means errors cant; get corrected even by the doctor that saw the patient. When one uses complex numbering systems one number input wrong can change pulmonary hypertension that qualifies one for home oxygen to a cold which does not according to the govt guidelines that are currently being ignored by the current claims processors but are the 'law of the land.' DEATH PANELS are already in place. and have been growing for a couple of decades. and any elected official who wants to change things back to constitutional fairness and saving lives and health finds themselves in a political battle for survival.by the elite who have been gaining control of us with our own monies.
In the SMART law we got a new law, instead of amending the one on the books, and just adding in the penalties. That's the detail that regulations will now have to resolve and opens itself up to court cases and the ins industry and others with big money will surely end up there. Will the media cover the story if this happens since they are mostly owned by the same mega entity?

I have never named him as I don;t have the DNA and only know as 'everyone' in Topeka and Topeka HS knew who the couple were and Ann, the president;s mother told my mother, her Great Aunt who had gdnshp and looked out for her and got her through the pregnancy , marriages untill she left after the birth in Topeka ks for Mercer Island Washington to finish HS. I have been asked by multiple sources if he was related to Rosa Parks. I will say one thing. He said he was to some other students back at Boswell Jr HS. when they asked him. That's my eyewitness source. Someone else mentioned the name Mcauley? and it meant nothing to me, then as that was not his name and later on, when I learned more about her , realized it was her maiden name. I don't have membership to Ancestry,Com, as my money goes to stay alive and I'm not the one running around trying to prove their president should not be the president. I have no knowledge he is eligible to be the president and those raising money needed to start following the path to the full truth.
If it wasn;tt for the mega money and international cabal trying to take over the world; it should not matter that much who is president or even elected to Congress as they are supposed to work for US. We do need those whose hearts are ones for justice and compassion and look out for the general welfare of the people of this nation first and for the safety of this nation first and foremost. We don't have to agree or like each other, but we do need to coexist and if big money was not involved, that would be the prime directive for those in elected office.
