When one looks at the corrupted mess one might understand why Pres Obama might want to start ruling by executicve order. But its not our way and those committing crimes must be brought to justice. 'White collar crime ' is not always the easiest to investigate and those commititng it against us well know it. . We have a Medicare law HR 1063 to enforce it and its power is widespread and goes to every facet our our system where some one or entity is obstructing the process and making Medicare pay bills under a 'safety net' that are either never to go there in the first place or repay to them. I do not have any monies received as has been said were paid by ACS et al. If such did occur I woudl have had to sign papers to get it and monies woudl have been repaoid to the govt and those payemnts woule requie an temiizationand that;s notposoible without the coms file. and all items processes. We don't even know what the 'damages' are so my attorny could go negotioate settlement for the taxpayer and me from any third party. But first Federal workes comp has to be allowed by ther contracror ACS-Xerox to comlte the processng of allitmes back to 1989 to even kow what the total is and even what body parts are to be negotiated in a scheduele award from them with all the due processes affored to all the parties in the matter. I my case 4 parties. OPM ,. ACS is not nee of them and is not to be casuing truoble and spreading rmorsand gossip in mulitple agencies to obstruct us form eti tthis cocomplished in due tome. 25 years is not a prompt process. in Fall of '89 ,my claims examiner in NY US Dept of Labor office knew my medical conditions and knew what ususally would progress form the injury and has over the years. She tried to effectuate a permanent disability then but was obstructed by outside influences. If she and all the others had been permitted to do their job, there would not be this hodge podge of part processed, part paid, appeals not answered in light of other evidence disappeared and no security on any file of mine, paper or digtial in any agency. Contracting out does not stop this it made it worse.
WHERE'S OUR MONEY FOR OUR CARE AS CONGRESS APPROPRIATED. WHY aren't all equal before the law as its being carried out now and has not for some time. None are immune from fines and penalties and the law under HR 1063 in many ageincies and entities whre Medciare had to pay bills not theirs. Medicare is not borke , its just filled with IOUS from those that never have had to repay. 20 years of letting every one coerce the stealing of it by the other health insurers and plans' contractros in the USA. must end. Others need that money. This is not a victimless crime at all as my cass shows and why I share it.Its too common place on many others.
Medciare has the onerous and so do all the federal agencies not to let this occur. If there is to be Medicare for all and no fault health care, with all workers comp paid by Medicare then Congress needs to pass the law. I don't think it would pass. Its just not our system. Liability claims is part of or system of checks and balances to stop bad behaviors, and make changes so injuries do not occur again.
Instead the govt has shirked its duty for 20 years and we have seen deaths, harms done and livelihoods ruined with rationed care all over from it. Our health system has become third world and yet the USA's Monies for it go where? Our doctors and medical staff are the best and deal with horrific attmepts to get pay from the proper party and in the highest legal amount due. AND IF ONE SUFFERS AN INJURY/DISEASE FROM TOXINS AND CHEMICALS, POLITICS IS INVOLVED ALL THE WAY AND CARE OBSTRUCTED MUCH MORE THAN MANY OTHER TYPES. Never should be. The doctor that treats you is not an eye witness to what happened. They can only deal with the human body in their care and do the best for them medically. They should never be asked to violate best care for patient and be coerced to not use their expert training and yesrs of experience to do that. Health insurers and Medicare has safety nets to pay for bills if there is litigation pending. They should never be asked to pay for one care already approved for care by another party or another primary insurer.
Medicare is not a 'dumping ground' for payment by any health plan that can get by with not paying their already obligated bills. And no contractor should be allowed to say what the facts are by withholding files from the govt officials who are to have full access and know. In my case the taxpayer has monies they gave for my care but they asked me to get reimbursement for them from Hartz Mountain et al and the govt and contractors are not to obstruct the Taxpayers right to try and get their money back for them and for me..
So while those castigate Pres Obama for the temptation of ruling without permiesiosn of Congress., maybe he and his cabinet officials he has appointed need to look inside the agencies under him in the executive branch of govt nad make sure that is happening to me and so many others is not going on.and stop it.
In all programs of govt run and regulated health care its not good and we are all under that reguation now in some way and that's been contracted out to entiies interlcoekd with the same ones I, my family and those providing medical care are dealing with and its not good at all. For me and too its life threatening.Son Just broght home a fileld oxygen tank and have to check for leaks to be taped and glued and paper work to sen in for artial payment from FEHB as all the clims sinet to ACS-Xerox are intentionally hidden form view of all at the ACS Ofce in LondonKy. TO BE CLEAR. I could show my claims s examiner papers, but, she can't 'officially' see them; nor do anything about them. I've tried and they have to mail them on to London, Ky and they become the deciders of fact ( with no due proces rights)of my case, not her, not even the sppellate judges at the US Dept of Laber who also have to send file we can reconstruct with them and therr orders/rulings. to ACS first and ACS decide if they should be seen.They overrule the judges! If this is not a coup d;etat, what is?
The fundamental problmem with 'Obamcare,' is exaclty the problems I have been dealig with in other govt regulated health plans TURNED OVER TO THESE SAMEINTERLOKCED GOVT CONTRACTORS. THE GOVT IS NOT REGULATING THEM, NOT ENFORCING THE LAWS, OUR MONIES ARE MISSING FOR THE CARE OF PATIENTS.
We have the laws, and due process needs to go out to all inside the govt, ineide the contractors and others no more 'dumping onto medicare who uses the same entities, too and have promoted it. Medicare Coordination of Benefits, ie e Group Health i. e Emblem Health International. is and always has been the key to this. tis why my US atotrey;s office said its the biggest Ricoo csei the history fo the nation. They are not to be altering official postings they get by contract form agencies and employers and do without any due process, or rights throwing as its not to be happpening yet they have even been aked to do so by govt officils who seem to be 'ignorsnt' that they are committing fraud and vioaoitng everyone's civil and constitututional rights by doing so. . If any postings are to be questioned then , then medicare has a safety net called conditional pyaments and a process to go through if there is disagreements. They are not to touch the sysytem at all for those who have aostings form other than the patient.I'm not allowed to change it either.I cna;t just say enough, and say let Medciare paya nd I wnat to retire. I cn;t legally do so nor can any one else with an job injury until the workes comp process is gone through to completion and permanent disability awarded in my case.
IF THE SECRETARY OF EDUCATION CAN DO THIS ON MY UNPAID STUDENT LOANS IN A FEW MONTHS back in 1997, WHY DOES IT TAKE ALMOST 20 YEARS AT THE US DEPT OF LABOR when my owcp doctor finally said no more work can be done, not even part time with all kinds of restrictions. and need for accomodations. Since 1996, the request is pending in a well documented medical file. SSA disability has yet to look at my medicals nor ask for more info from any of my doctors. and that obstruction camed irect from a former acting comm of SSA re the manager of the vlaims processing unit which is a state agency in OK back in 1999. This is an inu investigiated crime and bfroe the iellgal orders came down, they had already sent me to a board ceritifed pulmonologist and s reprots disappaeared. In 25 eyars all lung doctors all have been in basic agreement. .
On my accepted conditons there should be no issue of payent as medcial caer has bene basically the similar for years and approved.. Other secodary and tertiarly medcial issues are pending for approval and need to be done with all rights and then if accepted promptly repaid, too.
Its been 20 years since we had any semblanceof these laws carried out under Medicare, and few seem to understand exaclty what HR 1063 is or does. One has to go back and review the orignal law and what was done then.
Yes officials in other agencies and their contractors are covered. "Just letMediare pay ( forever)for not enforcing yor own laws and contracts , is not the legally correct answer. Its apprent something far worse has corrupted the processes of govt. A few investigations and criminal proseutions so far are only a 'peek' of what may be discovered to bertrillions of dollars of our mones gone missing in many areas of the govt? Medicare is only the begining but a major starting point.
A govt contractor is not to be hired to help steal and commit crimes and hide the acts of a high level official who is subject to sudit and more easily prosecuted and 'found out.'. The purpose of a govt contractor is for specific jobs to be done for a temporary type of job and/or hiring for highly specialized profesisons. Its not to turn the entire control of the processes of govt to them with out any overisght and being able to intervene in wrong doing which has almost effected a complete coup d'etat of the govt itself..
Its our monies for "the general welfare of the people and security of the netion" US Constituion.
I have found many who do work for the govt contracors very able and rofesisonal persons, but if they want their job they are forced to do as told. Its why, the govt has to enforce its laws and contracts. How could an ACS or any other contractor or govt employee 'blow the whistle and be safe? Its obvious they wouldn't be from what is on-going.
Years ago I said andstill say, the bigests problmes I;ve had with Fedeal workersk comp is deisruction of records. And it seems to occur jsut as or duing procesisng andpayemnts being made and someone des not want it to and it gets crieminally obsructed. 25 years of consisitent pattern of 'bad behavior; 7 US attorneys' say is a federal crime is not a 'clerical error.' Yet no investigiations are done as if they were , it would stop the behavior even if no one ever prosecuted.
I choose to live and wish my son did not have to haul oxygen for me and interrupt his busy life to save his mother's life. But I am greatful for famaily and frinnds who have stood by me through all of this. And my husband Doyle of almost 50 years on 1/26/14 who has spent the last 25 upholding his vow of " in sickness." As he said when he married me and for the first 25, as he says "I was always 10 steps ahead of him" and could breath deeply and without oxygen and maintain that for a two hour occonert or theater show without pain. Now any deep breath is painful.
I tried to work after injured multiple times but no attmept to aid in any restrictions occurred as promised. Many in Congress want to aboish the curent Office of Personnel system. as its too easy to pass the buck back and forth and is a breeding ground for corruption since 1979 when adopted. But no system as no health care plans will work if blatant crimes are allowed to become the pattern of on going behavior.
Presdient Obama executive orders to rule is a temptation; but asking your cabinet to stop wrongs on going and influence that should not be inside the govt civil service nor their contractors needs to occur any way.
