Medicare Coordination of Benefits: On 9/29/2010, Departmental appeals board ruled that OWCP needs to get Linda's claims first and affirmed the two lower judges ruling that fed Blues is also a primary to Medicare. yesterday, i was able to access mymedcaire.gov for the first time, unknown what claim number all the claims are under) and say only a few muscular skeletal claims listed as conditional under he Medicare secondary payer recovery unit. There are secondary/tertiary claims pending with owcp but until ACS set up my computer file and bring it on line with the official us dept of labor computer, nothing is happening and hasn't for a decade since Ill Blues took over in TX, NM, OK and ACS-Xerox took over for the us dept of labor is a real ' death panel ' decision against me. ( ACS-Xerox has 11 year a of oxygen invoices they won't input as the computer will pay them and bring the file on line as I was approved for life.) Hopefully you know understand that your contract violations with CMS and Us dept of labor in allowing any one and everyone to alter the official bi-weekly posting has almost cost me my life and and extreme physical and financial hardship and reataliations. You still show the wrong date of injury and this has led to mass chaos for billing personnel and obstructs medical care. ALL my claims are for either accepted conditions at owcp or for claims pending, sometimes for years in defiance of 6 appellate Judges and hearing officers who have remanded the case pointing out they have never been reviewed. only to have ACS ' disppear' the judges orders. Even their CEO misled the new Reg office manger when he contacted her over a year ago and led to more hardship. You have had a duty to hold fast to your contract and secure the official bi-weekly posting. Your protestations that you didn't alter them is defied by hundreds of witnesses an has led to claims not getting sent on to MSPRC and both your parent companies stopping in recovery back to Medicare which the US atty called a ricco situation.
Now the same thing is happening with Doyle's and our daughter's claims, one of which ended up dumped onto medicaid her third, payer. For them, Fed blues is primary per the same appellate decision and Medicare secondnary until the 1996 request that is still pending unanswered at federal workers compensation for permanent disability is approved. ( not even been seen)
All this because the 10 year lease needed to be signed on my injury work site in 1998 and I had to ' disappear' along with the 4 years I tried to work in considerably pain and with health declining as promised accommodations not done, yet receiving awards for what I was able to do. You were the first one I sent an appeal to years ago, as crucial to the underpinning integrity of the health care system as the former Sec of HHS set it up in the '90's. My son is hauling tanks and paying our of pocket over this as Lincare is now a monoopy supplier in this area and is refusing service until the ' govt programs' are again in compliance with the law? Congress gave this authority to the govt and it passed this responsibility on to you. Please never alter official records again. For the last 2 years, there has only been @10 min every two weeks that its been accurate before you deelted my Fed Blues. off our records. a decade of such ' death panel' decisions has to stop. This has put my life in jeopardy and obstructed medcial care.Now for my family. Explain to billing personnel who beg you to alter the records how to process a conditional payment which is the legal option. That's what conditional payments were passed by Congress to do: stop these shenanighans. Medical subrogation is something entirely diifferent and doesn't pertain except for those pending medical issues. not yet seen at owcp. Why aren't all the cliams listed until OWCP pays?

UPDATE; As of 1/12, Fed Blues person, under orders from the OPM govt contractor under CEO LYNN BLODGETT has been calling in and having the Blue Cross Blue Shield deleted off the records of self and family from te privately owned medicare computer. within minutes after it posts from the US Dept of Labor bi weekly.
1-800-Medicare is now forbidden to 'see' fraud altough contract requires it be reported if detected as often they are the first to know. Guess 'they' didn't know the great work '500' of them at General Dynamics ( formerly Vangent) had done for almost 2 years before 4/09 when they blocked our phone e phone lines after doumenting a pervase trillion dollat theft of medicare THEIR REWARD? DON'T EVER DO IT AGAIN.
WHy delete and not just flip it to a secondary ins as was done for years to have Medicare pay first and not code for recovery from the primaries?
None even knows we have the coverage without checking sepapately with Fed Blues as it posts active duty, not retired; as one of my two primaries along with Federal workers comp and the primary for those on my Family Employer Group Health Plan? All decded as correct by Medicare;s own apellate jduge on M09- 1406. whhc they said is ignored as their proprietary 'deals' within the ins industry and 'co- horts' over rules anything legally in place. Law, regs, contracts, judges rulings. the exact quote to me: "We don't care what a jduge says."
On 1/12 if one over 65 has medicare and retired then Fed Blues will only pay the lower medicare rate. Press release was to dioourage Federal famliies from not signing up for Medicare. Our pemiums did not change and the tzax payer pays the 75% of them as before. And yet, 50% of the clism itself is getting paid by OPM from taxpayers and that's a 'big secret?'
Obstruction of medical care too often results for us as ones doctor has to do as they are bound by contracts and Medicare signs them up through ACS-Xerox. Yes CEO LYNN BLODGETT ( interlocked) is in charge, there, too. Medicare is 'notoriously' not ccvering medical care for those suffering from toxic or chemical injuries and not every treatment works or even get diagnosed properly using ones for a more 'generic' lung disease or other body parts. Its 'complex' as done. LIke not wanting oxygen levels check as you do on a cardiac stress test and others so subltle its 'evil' and your doctor is caught in the cross fire of all of this. If a doctor sends you for a test and its not paid for they catch the ire?" Patient can face 'medical abandonment.
Federal Blues personnel say they have to accept the verbal orders from the OPM contractor interlocked with CEO Lynn Blodgett of ACS-Xerox. who has almost total control of USA and other naitons' data, etc..
Even President Obama has to "take his word" for matters?
Most of time I cannot call MCOB as the phone ilnes in my home are blcked form my calls requesting them to obey the appelalte jduges and not alter the posting they recive bi weekly form the U dpet of Albor as it vioaltes ther cotrac.
BUT THE IRE IS NO ONE AT US DEPT OF LABOR TO ENFORCE THER OCNTRACT EITHER. I have that in a fomal deciosn, they cannot uphold the laws of the land and we, and our public monies are all at risk when this occurs.
Where are the govt officials to stop this?? POWERLESS! And the ( Internal affairs)) Office of Professonal Conduct at US Justice Dept? A 'joke' for decades and shuodl heve been exposed by the 911 Comission in their work and evaded it as its all of govt not just HHS where this occurs. More Taxpayer money mispent?
This is not just about one patient's needed medical care. Wars get started with dead and injured because the system in place to stop internal corruption fails us.

Read of the first fines and penalties assessed under HR1963 which our cases well meet the law for the govt to stop this illegal dumping on to Medicare and I can retire and get all matters processed and paid, etc. what is the 4 times a possible billion dollars on all injured feds, or others since 1988? Is this why this line whistle blower is blocked in all attempts, and right to life obstructed also and the order: 'let her die" as paying for liquid oxygen for one could lead to a massive embezzlement by partners of the govt since 1988 and will this expose some diversion of monies at the Federal Reserve where all these monies go to send on to another agency? In how many other areas of govt has the same thing been going on? Is this the missing 23 trillion over all and none wish to face what has been going on, the stealing of America's hard earned monies.
update; Last Tuesday the bi weekly posting from my employer which is under the US Department of Labor now, posted to the Common working file owned by emblem health International the medicare contractor. THEY DID NOT ALTER IT IS THE RESPONSE WHEN I CALLED THEM the next day as a 1-800 Medicare had done that I had no fed blues, but a medigap policy , etc which I wrote of in in this blog. OK Blues promised to send a letter that I did not have the medigap policy and it has not shown up yet. remember ALL THREE OF MY HEALTH PLANS HAVE lYNN Blodgett WHOM gEORGE sOROS SAYS IS NOT RUNNING THE WHOLE COUNTRY WITH AS HIRED HAND OF HIS I only know it Blodgett that all the govt officials and contractors say has given the illegal orders and is in defiance of 38 federal agency judges on my cases. And it was a pulmonologist bills of 15 years ago and where is the rest they had sent out years ago and never paid back and vefbalorders to destroy records by Lynn Blodgett got them deleted.
