Cool and sunny day so  did not go to garden  Feeling a little better , but just could not get into all the ink and paper to work on files. Mail came and Fed Blues ended up not obeying the SMART law, which could mean $1000 day fine against them for processing the claim and paying fully for one of Doyle's medical bills when it should have been credited toward his deductible and Medicare paid. as they are legally obliged to for only co pays and deductible.s This is for a date of service after the law signed HR-1063 but before we filled out the questionnaire on health insurance for them for the years so that medical providers will have our signed statement  so they can have some ammunition to protect themselves from the SMART law over and against these govt contractors that don't care about the law , judges rulings. So far, the Dallas region is ignoring the law that could save trillions from Medicare and recoup another trillion back that is owed Medcare by other health plans. if enforced.
The I got a recap of prescriptions from Aetna Part D Medicare and no word about them sending this over to Medicare secondary payer to recoup form OWCP or Blues, the two legally primary payers for self.  So the SMART law is being ignored and Medicare is not going to be protected from every health plan being allowed to make Medicare primary because they dont want to pay if Medicare isn't going to up hold the laws.
 I have not heard back from Aetna's CEO, the letter is posed on line here in Daily recaps nor the parities it was given to. and finally called it a grievance as no one there knew anything about Medicare being a secondary payer  law as to  how the process worked. I had been informed that Part D could now collect back from the primary, something omitted out of the original law and so Medicare was tricked into paying full price for everyone's prescription drugs and if one has special help  the state funds kicked in to pay when the bill was not even Medicare's except for co pays or deductibles'
 So the taxpayer's money is still being skimmed and stolen and Medicare is not broke- its still being robbed and Congress passing laws  to stop it means there either is going to be oversight in Congress and. or some high level officials running these programs need to be fined the $1000 day day for not doing so. I see nothing in the law that says a govt official nor govt contractor can't be held accountable. Its time for some accountability to end the chaotic mess that's gradually gotten worse over the last 30 years since a step by step plat to coup d'etat the nation's monies and peoples rights was put into motion.

"I TOLD YOU SO?" I hate to have to say this Ms Orly Taitz but there has never been any issue that President Obama was born in the United states and is eligible to be President as Topeka Ks is in the USA.
 So the US Supreme Court is not going to here the case. The other issues are a matter for Federal law enforcement and does mean that a lot of oversight hearings and investigative hearings need to be held in Congress over the way law enforcement is handled in general inside the federal agencies. As I said there as to be a file on the SSN's and resolved a long time ago  if what is out there is truth. As for statements one makes  about where they were born; they were not under oath and I know he wan't told truth as of 1/71 and still may not know it if any one has shared any of my e-mails  with him.
                                                       US SENATE VERIFIED CITIZENSHIP
What many do not know is that when one run for a US Senate Seat, the papers are  filed with the US Senate. They have had the authority to question his citizenship since he first notified them of intent to run, even before he filed with the State of Illinois. I know this from when a family member was preparing to run and did file the initial intent but did not follow through with the full process. This is different than the process to run for the House of Representatives. And they accepted his citizenship when he took the oath for the US Senate seat from Illinois.
I know that all the Judges know this also.
 Are there issues of unethical or criminal acts in the past? The face of the record would tend to seem so, but most would be beyond th eststute of limitiations for any prosecutions as far as I would know. All this shold have been known by the voters for them to decide if it mattered. If the emphawa had not bene on the birth certiifacate then it might have changed a lot of things. one way or another. We will never know.
There is only one obscure thing that might make him ineligible and the records in Kansas should show tihs if it occurred. That is an Indonesion adoption plus a revocation of citizenship with the US State Dept.That's two separate acts.
 Ms Taitz still has a judge in Shawnee County Knsas waiting for her to ask for the courtt order for the records.
 And if any one was concerned about the truth there would be some cooperation from those with all the donations to at leastt check the newspaper accounts of birth, marriage to Obama Sr and  death certificate of the real Dad. All in Shawnee County, Kansas which is Topeka Ks.
 Those that dislike the president for either politics or character, etc. would have been better served to have gone for the trurth and confronted him with it and then he would have had to say when he knew if he did or find out the truth for the first time.  Most of our extended family may not even know that  Ann was sent to go live at Westboro Baptist Church and Fred Phelps and had to leave and was on her own until the gossip frenzy over the interracial couple turned deadly and the authorities had to straighten out and find who her paternal relatives were to take charge of a 15 year old pregnant girl who could have died along with her unborn child, also. and her boy Friend. in the Kansas river and was searching the river herself for the body and would not stop asking for help and justice from authoritiies that were part of the cover up.. That's when they verified that Dunham was not the fmaly name but a stolen ID for  her father to go to WWII when too young, married when too young and had her. They contacted my Aunt and Uncle Millard Dell and Helen Pope of Holyoke Colorado who in turn contacted my parents Aunt Helen's brother Rev Tracy Hardy and My mother Florence Hardy took charge when she was 1/2 way through the pregnancy. I knew the real Dad, who had said he was a relative of Rosa Parks and Ann but had no idea she was related..
 THE WHOLE CITY OF TOPEKA AND TOPEKA HS KNEW and when the bodies washed up on the sand bar, with one having a rope aorund his neck; later on before 6/62 the whole State of Kansas knew. But the gossip stopped for 50+ years when the bodies went into the river.  If DNA is needed, there are a lot of Pope descendants around.And don;t bother doing a Google search. There's been no lynching in Kansas since 1922, according to the official records. None has been investigated since then?.
 There was family of parents and four daughters and a son that arrived in Haxtun Colorado about a hundred years ago and the descendants are scattered and many of us do not know who we all are. I'm the youngest of the children of the five siblings and I have had the advantage of knowing the five siblings and some of my first cousins, but no one well as we lived in Kansas and most of them were still in Colorado as I was growing up.
 But I am eye witness to what I know and what I saw and I do remember the announcments in the paper, the Journal which was the evening paper.  The Topeka Capital Journal is now owned by Morris and not Capper's and they will not allow their reporters to even check archives for death . marriage and birth records. I am not in Kansas and do not have the money for all the search engines if they might be on them. I do think I saw a partial of the death certificate of the real Dad. I Say it that way as I got the info from the general knowledge of the couple, but Ann told my mother and she had guardianship of her. and was there at the birth. But she did n''t say much to me until later when the bodies washed up and the name was in the paper and asked if I knew him and I said yes, don't you remember him? He sang Old Man River  for the music program at Boswell Jr HS and played football for Boswell  Jr HS and Topeka HS. But he's not in the football pictures  in the 1961 yearbook as if the city  and school just decided to write him out of the history along with the other 'rumored' disappeared' whose bodies never washed back up on a sand bar but were sent on down to the Missouri and Mississippi Rivers and out to sea in the strong undercurrents of the Kansas River.
We make fun of other nations that deny the Holocaust in Germany in WWII, but we have our own terrible things done by humans to other humans and we have successfully covered then up for too long and just keep repeating denial of rights to each other over and over and never bringing any one to justice for crimes they have done then or now. We have let out social conscience get blunted instead of being transformed into love for justice and turuh and caring for one another and creating world peace and not war. We do not have to like each other or even agree with each other, but we are  social beings called to love one another and to co exist in peace as we respect each other's inalienable rights to life, liberty and the pursuit of happiness.
PARENTS DENIED A CHOICE
A teenage couple, finds themselves pregnant, should have been the personal business of them and their families. It was not the business of those filed with hate nor the self righteous that necessitated the need for a young woman to have a marriage ceritificate  for a social neccessity of the time. Who knows what the parents of the president might have decided to do as they sat on the river bank trying to make plans. That choice was denied them because of hated and others taking a personal family matter and making it the world's business. Now the world is still trying to find records because fo raical hatred that caused so much fear that family created a fake bio and  his grandmother may have  done something illegal in getting a birth notice out of Hawaii. I wish the president would get the records out of Topeka and explain it to the pubic so we can move on and work on solving the nation's problems which are immense.
Plus I've been trying to get Congress, for years to solve the chaotic and and unjust mess that the Office of Inspector General System is that enforces most of the laws of this land inside agencies. Its a political decsion and never should have been allowed to be put under the authority of the political appointee in an agency. It would be better to have it all at the Justice dept with divisions for each agency or Cabinet Dept so that Prosecutors and investigators inside the OIG could work together. Much of the fraud going on that We have documented, which  is major;  has been stopped by political appointees inside a regional office her or there and even the FBI or other agencies can;t do anything because of one regional political appointee that evidence shows should been  under investigation themselves but they can say don't investigate me. There is supposed to be an office in the US Justice Dept for high level agency corruption, but its been a 'joke' for years. The current AG Eric Holder has tired to address this but so far its only resulted in other corruptions real or created against him and one wonders if this would not happen to any one trying to clean up Washington no matter what political party or political ideology they might have.
THE CONSTITUTION OF THE UNITED STATES ARTICLE II SECTION 1 (phrase by phrase analysis)
"The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same through out the United States."
 Congress has the ultimate authority to decide the time and place of election. This refers to the Electoral college. But its become standard for first Tuesday in November if the presidential elections and then the electoral college meets and casts their votes and then Congress has to get the results and okay it.
