This is a series of links backwards of transcript of actual brief for Medicare hearing where the judge was only permitted to rule on an issue already resolved yet hearings pending for years and disappeared appeared in the small file sent to the judge without attaching documents originally sent and the systems hacked and appeals not even on there to date I filed., But the 8/09 hearing that had disappeared form the McAlestar, OK SSA hearing office in 9/099 and system t hacked into to delete off the system miraculously also appeared on the system just before ACS ET AL? prepared pieced of all to send to the judge.
I have spent some time verifying that SSA and Medicare have no guidelines or info as to who gets which hearings and in the 8/09 still not heard nor answered, but one issue done from some few papers sent to associate with it; are issues that apparently belong to each. SO DO I HAVE TO WRITE THE GUIDELINES AND ASK THE JUDGES FROM BOTH AGENCIES TO ADOPT THEM? to get her own cases heard?
Problem is the reconsiderations came with SSA letterhead for the hearings in this file and she knows and am fairly certain after all the info gathered that ACS ET AL AS contractor did them and why nothing got resolved and Linda harmed financially and physically with medical care interrupted and medical bill collectors and with nothing on the system , all keep on processing and I keep over paying on Linda's Medicare premiums where the amount in question is now over ten thousand dollars and amount grows monthly,. Contractor employees may be nice people but they need access to info and laws and rules and systems that are not hacked into and the authority to make these kinds of decisions and not just pass them through undone and do it in the official name of SSA. or any agency.
FEDERAL EMPLOYEES PLEASE WILL YOU WAKE UP AND STOP TELLING ME TO FILE WITH OFFICE OF INSPECTOR GENERAL. THEY HAVE NO BUDGET TO INVESTIGATE A CONTRACTOR AND HAVE NOT HAD ANY FOR YEARS. MAYBE ALL SHOULD SIGN UP FOR THE PRESS RELEASES FROM SSA AND CMS AND REALIZE THAT MANY OF OUR HIGH LEVEL OFFICIALS ARE BEGGING CONGRESS FOR HELP.
AND WE ALL NEED TO SUPPORT THOSE WHO ARE TRYING TO MAKE THINGS BETTER AND CONSTITUTIONAL FOR ALL. I, Like you knew less of my own rights as federal employee than the program I made decisions in . But now, those on duty have less info available than we did years ago before the contractors put everything on web sites and even categories of benefits disappeared without an act of Congress or a judge saying it should not exist. When a few lose their rights then all of us become expendable as we are individuals and one is too expensive to allow to have rights to even live.
J in KC could not understand that OIG could not and have not been able to do anything for at least 15 years, when I became acutely aware of gross illegal activities going on. inside govt contractors.. Many still do not know that often they think they are dealing with co federal employees and are dealing with government contractors impersonating them. ITS HORRENDOUS FOR SSA EMPLOYEES TO BE BURDENED WITH RECONSIDERATION LETTERS GOING OUT IN SSA's name when its obvious no one in the govt did them.
And Govt contractors are not trained to , nor have access to official info. r the authority to get it. Maybe there would not be a back log of Hearings if real , trained feds were still allowed to do their job. and we got reasoned decisions based on the legal issues raised addressed and agency judges obeyed when they do rule. even the 2/11 judge remand did have enough to know that the crucial issue in many ways was to get that reconsideration and disability decision done on me without illegal interference by outside parties that had no right to interfere and allow the decision to be made based on merits of the medical merits of the case. BEING APPROVED FOR HOME OXYGEN IS LIKE A DOMINO AFFECT FOR ALL OTHER DECISIONS AND APPROVALS TO FLOW FROM BY THE LABOR LAWS AND OTHERS AND REAL EFFORT MADE FOR YEARS TO OFFICIALLY HIDE THAT I AM ON IT 24/7
Some are having their own jobs taken over and seem oblivious to it. Or was J a govt contractor in the public affairs office at SSA as the encroachment intrudes into one agency which has still remained more in the control of real govt employees who are subject to the laws, audit controls and criminal oversight if the rare one breaks the law. I AM DISGUSTED WITH A MEDIA THAT BLAMES THE REAL RANK AND FILE GOVT EMPLOYEES FOR WHAT SOME TEMP, UNTRAINED CONTRACTOR EMPLOYEE DID . Now will that high level person who is breaking the law, allow my local office work through the back log their malfeasance created over the years. with gossip and rumor running amok instead of facts and merits of cases and the law..
Govt employees seem to be the 'last to know' what has gone on. Time to wake up as is only your life, and livelihood at stake here under this international cabal. THAT OIG HAS NO BUDGET TO STOP THE ILLEGAL ACTS OR UNETHICAL BEHAVIORS THAT has harmed me and so many others with deadly outcomes.. Please support our leaders in Baltimore that are begging Congress for some budget so they can stop this looting of the public treasury and every ones basic rights of life and livelihood. that are currently often not their when badly needed. the gossip ill probably has me pegged as the 'horrible person" again for trying to find out facts and process so I can ask the judges for orders and them if they cannot act, on o Congress and put this clearly in their hands to do the jobs we hired them to do or we need to fire the ones not doing the job next year. at the ballot box. So VOTE.
MANY OF THEM ARE NICE PEOPLE AND WOULD BE GOOD FEDS IF CONGRESS WOULD ALLOW THEM TO BE AND PROVIDE THE TRAINING SO GOVT WORKED AS IT SHOULD FOR THE PEOPLE AND SECURITY OF OUR RECORDS AND DATA SYSTEMS AND OUR RIGHTS.

Cover letter and partial response(what we have so far) in response to blatant misrepresentation of files by ACS et al? In no way has Linda done anything but persistently pursue justice and right to live.
Caution: remember 2/09 3 appellate judges said : gossip and rumor had run amok and Linda is to be asked for facts of case let her reconstruct files and process, pay etc. ACS et al has withheld that (un)* officially. It appears you received bits and pieces of (several unheard and pending hearing)* file(s)* from ACS et al on 1-322588488.

Invoke Teri Schiavo law (as Linda chooses to live and medical care being obstructed over what is occurring without judges rulings being obeyed and current issues going with no judicial review for years, also. as system s hacked to delete the hearings even pending with resultant chaos created in her files from those continue to do things on cases not getting permission from judges to work portions of case. Now it appears the contractors have had these and not any federal employee at SSA or CMS.. has had custody of the disappeared data and files?)*

( many other issues pending in these hearings other than this but SSA did the reconsiderations in their name even if not done by any SSA EMPLOYEE WHICH APPEARS DID NOT DO NOW. MIAMI Medicare hearing office has many hearings pending with persistent follow ups and none scheduled by ACS et al? as well as remand orders form prior judges not carried out putting medical care and life in jeopardy daily, and its now known of this being a trend by this contractor to obstruct medical care that never should occur. when approved for life medically. as Linda's is.)*

Aug 5, 2009 hearing file and addendum that disappeared in 9/09 & no judge ever saw it (and issues not heard. 2/11 remand order done with out the file on disability insurance reconsideration informing SSA that they had not yet done the reconsideration which is crucial as US Dept of Labor FECA could adopt a legally done disability decision of the state agency who does the disability decision for SSA since 1956.l had not been illegally interfered with them and told not to use my medical records, nor contact my doctor and the consultant reports and pulmonary function studies and test for pulmonary hypertension disappeared also and state agency ordered to put down what the acting Comm of SSA said to and they did re Manager of State agency. etc. , but did note that they had no medical records to back it up, and did not list any other medical conditions , not even that I was an oxygen patients approve for life by FECA and the many doctors who prescribed that and other heart and lung medications based on all kinds of medical tests, etc. And many well respected and even published by peer journals doctors in the fields. Yet the one who did this could say who could be investigated and I was not aware this had occurred for years on my case as I continued to try and get the missing consultant REPORT AND WOULD STILL LIKE TO HAVE IT AND THE RECONSIDERATION PENDING SINCE 9/00 COVERS THIS ON THAT REMAND 2/11 ORDER AS I STRUGGLE FOR LIFE AND LIVELIHOOD OVER IT.
And I get blamed for just going to work one day 1/10/89 and being over cone with a toxic cloud doing my job as I had done it for SSA since 6/68.)*

I am exhausted, but need to keep on working on this as this is a tremendous job to straighten out the whole govt just to have the right to stay alive. Thanks to L. who did say she would try to find out things and call me back. Pray she is not ordered to not do so.ALL THOSE INSIDE OR OUTSIDE THE GOVT DO WHAT YOU CAN WHEN I CALL OR YOU GET ANY PART OF MY FILES OR ANY ONE ELSE'S. AS WITHOUT OUR CONSTITUTIONAL RIGHTS WE ALL SUFFER AND TOO MANY ARE AND HAVE LOST THE EARTHLY BATTLE ALREADY AD THAT IS NOT RIGHT AND THERE IS AN ETERNAL JUDGEMENT FOR ALL OF US TO ACCOUNT FOR WHAT WE DO OR NOT DO. IS MY FAITH.
