Even if one has a mild exposure, it has caused injury. Will one heal? Its a 'rule of thumb' in the medical profession and among those who process liablity cases, that it can be 2 years before tis known and how well. Beware of hurried settleemnts that do not seem fair if it can be a life long progressive disability Having a good atttorny who undesrtands all this, is helpful.Other body organs can start failing over time from the injury plus long term side effects of some medications such as cortisone steroids is well known.
I filed for a scheduale award for Fedearl worekrs ocmp in 1996. after my doctor wrote I could no longer wark at all.And US Dep tof Education waived student loans saying cold l not even go to school based on Occuaptional Asthma. If it had been processed timely and perrmemnt disabilityi awarded so I coudl legally reitre, then some of what is now known would have been missed. "Jokes" on the 'they' but this is no 'joke' its real life theatening situation 'they' have me in.
Its for this reason, the chaotic mess my repeatedly disappeared file is in need of a systematice working and common sense logic mean a chronological year by year processing once the file gets reconstructed from my records as the file is missng mulitple times at ACS and shredded according to witenss a few years ago of what they still did have for me and others similar due to ACS's care of security for files has 'unsecured.' it..
As long as current needs are met so I can live to aid in working thorugh this I am willing to cooperate fully in the proces. The local office tried to do this in '07 but was stopped as ACS has the contract and the local office is not allowed to as they can't provide 'security.'
Worse is someone did this with a fomal denial and appeals back to the judges who ruled otherwise The local office, without the file and somene verbal wod, .saying I couldn't have any benefits as Idid not return to work in 1990 ( I did) and lost my ights to life and beefits. I did and its well ll documetned with over a doxzen union greivances, arbitration case still penidng ; 240 EEOC complainnts ( some still pending )incluuing EEOC sanctions agianst Sec of HHS Donna Shallaa for physical torture to the point of death multiplel times. as the written promised phsyicallaccomodations of a non ertional sedentary job and removal of chemical barriers was not only blatanty ignored, but I was not permitted to work wth our regional handicap coordinatior to assure all understood what was needed. Its why the current malfeasance on civil rights complaints with Dallas Regional HHS office of civil rights is also filed as a retaliation for past and pending matters .( Homeland Security party said over a decade ago 11 deaths so far from 1/89 of those on duty in our office.)
After 25 years, its time for this malfeasance to end. If some are prosecuted, so be it and should have been long ago. Don;'t blame me for what others have done that should have been stopped inside the govt , even before we enteerd on duty in a building doomed to injure and did. Those who have done the deeds and others believeing the verbal "nothing to do" when the highst legal authorities say there is and my current needs not being met as approved should understand I chosoe to live and all of this should have been procesed fover the years rather than let a pattern of malfesance go on.I look forward to a positive conclusion and a better quality of life spendng my time not having to write this kind of request. Then believing "nothing to do" from one continuing the malfeasance.
Some may well not understand that I do understand how to work through a claims while giving due process and appeal rights and am willing to fully cooperate to get the work done which should not take more than a few months.. I am also willng to wait until the process is completed to file a reconsideration on any item, we may disagree on whether it should or shoudldnot paid or medical condition added, Later years worked may solve the issues raised. But FIRST LINCARE NEEDS TO BE CALLED TO LET THEM KNOW THEY MAY FILE A CLAIM IF THEY COME . In file are ones I field for them and for Rhema. but they didn;t file.The company they bought out did and got paid by you. If LIncare then RHEMA but they are very upset me with me for what ACS has done and I want me to change the whole govt in order to susutain life. I have not had problems with delivery persons, except when LIncare, in 2000, took tnaks out of house under OPM orders to 'let her die". But they came back and those delivery perosns were never seen of again RHEMA thinks I blelong to LIncare as they hold the sub sub contract with ACS Federal workers comp and will not release it. This is all from their corporate office in Florida,not their local staff... Their local staff has been courteous over the years since ACS casued them to medcially abandon me in 5/06 saying I had amillion dollars to pay and didn't although ACS call center persons 'saw' it on the screen? I'vewrtten moe of the details elsewhere and tis worse and ivovoes ACS et al in multiple other entities . But their coporate staff takes orders from ACS CEO Lynn Blodgett as his sub contractors is Rhema as well as Lincare. ACS is'partner of CMS to sign up medical provders, too ... its a convoluted mess of conflicts of interests all over. . All other small liquid oxygen suppiers out of business since 1/08. I am using a tank our son gets filled at the gas company and its held together with Krazy glue and Gorillat tape and we have to lower it occasionaly to get liquid oxygen to flow to top of tank. It needs replaced and only Rhema or LIncare can do this with current rules out there at present and have health plans billed. All have to file with ACS first and they won'tt permit it and will never process it as they hide I have been on oxygen all along siince Federal workers ocmp put me on it 19 years ago. and wll not provide a tank unless I am a customer they servcie. ACS told both I have a million dollars from you and I don't..Where is it? Why does OPM OIG think there is an embezzlement ring of as much as a billion dollars inside the govt and no one allows them to investigate?.CongressionalHeaing in 7/13= no money allowed to be spent on such.Must still be going on ?
Its this work that is needed for all to fully cooperate on the third party law suit Federal Workers compensation made me filei in order to get benfeits in the first place and it can not go forward to see if the taxpayer might still get some reimbursements until the total mamges are known. With all the illegal abuses against the file itself, long delays has casued other medical conditons to be discovered over the years and CA1's and Ca2's are pending for acceptance on those.
When the total is known, then my attorney and those of the govt can go ask for a settlement to repay the taxpayer. And Medicare wants their moneis back and Fed Blues is to get reimbursed also as well as Mail Handlers as an associate member which I had from 1/10/89 through 1/9/91 when I swtiched to Federal Blues. Prior to that I had had AFGE Union Ins and is the reason I was able to get the necessary tests run to prove Inhalation of toxic fumes as that card was shown to the admissions clerk at the ER in Jersey City as the person who went through my purse to find info on me pulled it out resulting in Port Auhority put down oas my employer on my chart. (Misread as ASCFME?)This 'separated' me from my co workers getting turned away with no tests or needed care.and tsets and dignosis done and being prepared for admission for further treatment as I was near death. When the diagnosis came back it was toxic fumes, froms had to be filled out for the New Jesey Health Dept and the ER doctor found out I worked for Health And Human Services at Social Seucurty Telelservice Center 9Th floor 2 Journal Square Jersey City NJ and orders already had come donw from the peer review we were to be blackballed for life for medical care and "nothing needed to do" for us. This done before we even got to the hospitals in the area. Instead of being admitted, I was 'sent home to die." Ambulance called and taken to another hospital and admitted and doctor assigned fought to keep me in the hoptal but the 'they' of the world said "nothing to do" and was discharged after they gave me a shot of anabolic steroid and I left with my lungs burning as if a hot iron was in side.them/. Bleeding form sinues started and pain and infection set in and Husband called to find a pulmnologist first and he took me to hospital. Admitted for 8 days with lung barely open. and that doctor was mine for a decade and would still be going to him in Jersey Ciity, but Dallas Fed workers comp made me find lcoal one even though I was willing to pay the difference in mileage to go and all said not to change. My file had been in Philly and in KC and neither of them made me change. Since then, its not always been easy to find a pulmonoloigst and often harder to find a cardioloist as a pulmonoligst needs a cardiologist to monitor in order to treat as a matter of medical ethics? Common sense?
In the Dallas region there are only a few Pulmonologsts even listed as treating Federal Workers comp patients on the list ACS has on line. BUT when I called it wasn't true. What they have is a doctor called into a hosipatal and "nothing to do" afterwards. In the Dallas Region federal workers employees are 'forbidden ; to have a lung injrury? And if one has had one that sent them to the hospital and workers claims filled; there is going to be some kind of long term care needed. Often, like me a progressive disease leads to permanent disabilty at some point and most likely will contribute to ones premature death at some point down the line.
What used to be 5 years is now mulitiple decades to live with the progressive disease. as so far there is no known cure. And the chances of findnig such is minimal when FDA won't even recognize we exist even though the medical profession has for decades. Missed is one large incident after another where studies of injueies could be done to learn more what to do.Many estimates are 2 million injured from the toxic fires from Gound Zero after 9/11/01/ We hear about the 'first responders ' not geiting care, (where's ther oxygen?)but air has no boundaries and all those in the area breathed the same air. Not only were they 'left behind' by our govt but the back lash against ther rest of us in the USA began to see our successful treatments messed with in ways I have writtten about here.A subtle underminding of the medical profession to provide best care for patients.
Medicare has almost completely ignored us , too. But a doctor can treat our symptoms as often many are similar. to othe rlung conditions even if the meds are not always the same ones needed.
Most inisidous is a separating of pulmonoloigsts and cardiologists form working in consort with each other for treatment. as it was back in 1989 then later they were allowed to get together and now its been pulled apart.
A cardiac strss tests and oxymeter shoudldalways be done at the same time to get the 'full picture and rarey done any more. The cardio pulmonary stress test is the key diagnostic tool for one like me and the University of Texas Machiene broke and manger ACS et al says "nothing to do " to fix it as now none in Texas, etc might need to use it so doctors can know how best to treat? Lung injuries nt occurring in Texas?
And Medicare Part D puts the meds that did/do work for us often in t he tier that has the highest co pay yet for other kinds of lung conditions have a lower one..Why?And no generics many times. 3M came out with Maxair Inhaler in 3/89 and its for small airway disease. A amaller molecule than the Albuterol which pulmoanry studes show do little good for me. The ones out now have an inflamming asthma trigger as ingredient. so can't evn use it. The FDA went afte 3M r them becsue the holder 'gummed up'. Well for years I would run some water over it to remove it. So they stopped making thaat and made the Auto inhaler Maxair.. which I couldn't use. as not able to 'suck int the air" So for years have put the canister in an old marxair hodler to use it.I still have some, but when it runs out , no substittue for any of us. Can it be compounded, too.?
This is what one calsl my r'escue inhaler' and Intal was used at the same time throughout the day as needed. Being g home, one can control some what to not have inflamming triggers as Formaledehyde being the worse, away from me. either to breathe or eat/drink (Aspartane ,MSG etc break down to this.) . But its impossible to control the total even in a more rural setting off a main road.

I share to let others know who have similar medcicl problems what my doctors and I and others have learned and what we need to do to convince those in authority and elected to office to do. First to prevent such horoific injrues and then make sure the best treatments are there that medical science ecan provide..
My coumpound cost $25. . Yet those new inhalers out I can'tt use safely can a cost $175; I was recently told. COSTS IS NOT the excuse. WHAT IS/
Oxygen is more expensive, as we can not use the ozone emiting concentrators. But the least expensive method of exchanging filled tanks of liquid oxygen 3 or 4 times a month was done away with and most small medical suppliers were doing that and would hire a delivery person part time to care for a few patients. I'd call the gentleman's cell phone when needing an exchange. Mine had 6 patients while another in our area had 3. But in 1/08 a supriseingly fast regulation was passed by CMS saying they had to hire a respiratory technician and with only a few patients they were all forced out of business doe to cost for that. Patients go medically abandoned nclduing me as the big companies like LIncare and Rotech/Rhema were able bid for CMS exclusive e sales territories under the new compettitve bid programs whc they would have lost to the small companies. without high lialibty cost due to nature of how they did it.
Medicare will not pay if there is no supplier so they have hidden how many of us exist, just as ACS, one of their "partners" has done with my oxygen claims at Federal Workers Comp. Other plans as Fed Blues has reimbursed me @60%. My Medicare Hearing to over turn this unconstittuinal process to deny any one to service then not wiling to pay if we go direct to the gas compnay to fill a tank has been penfing for over 5 years with ACS et al to give to a judge. and Civil Rights Complaints with HHS Office of Civil Rights in Dallas go unswered for over 5 years, now to. Even thugh I have followed up. So due process rights to life and livelhoods is disappeared in ways many may not understand until they are needed to live.And has little todo with having Health insurance at all. I have three, with no issue of needed care and here I am writing about t a true 'hidden holcoaust' going on with deaths learned of in other them media controleed by 'they' and no one calls them a homicide as"they' say "nothing to do"
HR 1063 WOULD HELP, SIGNED INTO LAW 1/11/13 YET NOT IMPLEMENTED AND ITS PAST OVER DUE. Insurance companeis are 'squealing' about needing a trillion dollar bailout. They got that already over the last 20 years with no enforcement of recovery for bills they made Medccare pay and were their bills. So, 'they' pay the trillion dollars back to Medicare, then maybe we, the people might review if you can be repsonsible with another trllion dollar bail out? "We"don't wnat any more 'blank checks' of bail outs." Now some are speaking of Medicare for all So if the insuracne companies have to pay back medicare, what next? Without HR 1063 not implemented how soon will more monies be 'stolen' from Medicare and not repaid?The whole health care industry has become 'immune' to understading that its theft. of Medicare and others who are to pay bills as ACS et al in charge all over the cuontry in state and many Federal programs needs to understand 'they' can't take a millon per head and then not pay the bills? Personally I am of the opinion that the call center at ACS and did they see it being sent to some bank account number, that was not mine? And the Govt OFficials are not allowed to look at their computer screen or know what happened to the people's money to be used for me and pay for oxygen and other bills.Thanks to the people of the USA for providing for my care I didn't get it not the care so all need to ask: WHERE'S OUR MONEY/.ONLY THE FEDERAL RESERVE KNOWS WHERE THEY SENT IT ON TO.... Some say the million for my care is only a part of the 23 trillion missing...that went to the Federal Reserve to send on to a designated agency or party it never got to. Some insiders say it was to have ended up wth OPM and I am to use my Blue Cross /Blue shield and they would be reimburesed 100% on claims was the process originally set up under the 1988 laws where if one had an established case and life threatening medical need like oxygen permanent medical given and stop the abuses of obstruction of medical that had slready been going on before I was even injured on 1/10/89. .... Currently am told by OPM official in the Health Ins unit that ,50% is paid by OPM to Blues and no one else is aware of this for other patients. So where is it and what is going on?
