Federal Appeals Court Gives Boost to Hospitals Seeking to Resolve ALJ Appeal Backlog | Liles Parker PLLC ny one who has been reading this blog over the last few years, knows that its been years to get any access to Medicare judges as the contractor has blocked it. The only access was last year when several surfaced in a sweep to deal with those who had fraudulent tax returns filed in their names and appeals filed on the resulting increase in in premiums for high incomes we did not have? An IRS did send my info on to SSA, so ALL INDICATIONS WAS THE MAKER OF THESE FALSE RETURNS AN ALLEGED BILLION DOLLARS SOURCES WAS THIS CABAL UNDER CEO BLODGETT. AS IRS SAID THAT MUCH DID GET SENT OUT, BUT NONE ON ME AS I HAD FILED WITH DOYLE ALREADY.
This year we are all being advised to file early to block any theft again. And we have been filing for years, even though we do not need to. But the judge would not hear the other cases pending for years before him. STRICT ORDERS THAT ARE UNCONSTITUTIONAL AT BEST. None of the official systems across the board are secure that the contractors have the only access to in most cases . We taxpayers paid for security protocols that were never installed and our officials have been denied access to check things out. Congress will not permit it to be secure if what we pay for cannot be overseen by the government officials who are still subject to audit for their work and can be arrested if they break the law. Unlike the government contractors, except the defense dept since 2002 has some, but not enough.
. AND AT MEDICARE SOME LAWS NOT ENFORCED SINCE 1994 WHEN THE LOOTING OF MEDICARE BEGAN AND GOT WORSE BY HEALTH PLANS AND INSURERS ALLOWED TO 'DUMP THEIR BILLS ON TO MEDICARE. THEY ARE LEGALLY TO BE PAYING.
That one case that got through do to a sweep to clear up a group, led to an appeal filed to get the cases remanded back. for hearings.' Someone did include all on issues of premiums and picked up several of the hearing that have never been heard , yet. And included them in the file for the judge and AFFIRMED THE ILLEGAL ACTS GOING ON TO BLOCK RIGHTS TO HEARINGS ON ISSUES . Including some at SSA, that involved a case with multiple jurisdictions. I am a victim of a thousand crimes, and wish to have some kind of 'victim rights that includes at least my constitutional right of security of files and data which has not occurred since 1/1089 when injured by a toxic cloud enveloping me.
And all 90 of us 'blacklisted' for life before we got to hospitals, etc. ALL I DID IS GO TO WORK AND DO MY JOB ASSISTING THE PUBLIC WITH THEIR BENEFITS RIGHTS. THE GATE TO 9/11/01 BEGAN AT THE SSA TELESERVICE CENTER IN JERSEY CITY THEN AND BEFORE THAT IN 7.88. AND HE TWIN TOWERS ARE IN THE GROUND OVER OUR OWN NATION'S INTERNAL CORRUPTION AND COVER UPS THAT ALLOWED EVIL TO COME IN UNFETTERED AND TAKE ADVANTAGE OF ALL OF US. And the gate keepers of the nation let us down , then and are still doing so. AND BE SHOCKED AT THE TRUTH THAT HAS BEEN HIDDEN FROM THE PEOPLE AND THEN VOTE AND TRY TO FIND THOSE WHO STAND UP FOR US AND OUR NATION
Much of the log jam is that the lower appeals are being done by the contractors and they cannot apply the law, regs and issue decisions as govt officials can with access to more factors that a contractor is allowed to have. But govt officials no longer have access to files and data any more to do research for the facts etc. and library of precedent cases which are to be applied to same issues..
So the first time any one can get an appeals on the legal issues and really get anything done is at he first judge.
SO what now, when can I and my family members affected get to have hearing on issues that have been pending for over 5 years in some cases. In 2009 four appellate agency judges ruled directly against CEO Lynn Blodgett who rules the USA in nearly total immunity from Congress. as the 'face; of this cabal. He then went form agency heads to agency heads and lied and said that I had gotten a workers comp settlement and there was nothing to do on my cases. Thus enforcing hie order to "let her die' as medical care and oxygen supplier were blocked from coming.
I am only alive due to my family hauling 200lb tanks to a gas company and we paying out of pocket. I am approved for life for home liquid oxygen by three health plans so that is no issue in all of this. I was able to get some 60% back from fed Blues but his management firm over there has refused to process anything and for 2 years as they now want a letter from Medicare which doe snot cover if there is no supplier and that hearing has been pending for over 5 years to over turn that regulation as life threatening and unconstitutional . Yes, agencies can change these types of regs if they are shown to be unfair. and in the past when government worked, many things got made more fair inside agencies who have a lot of leeway in how laws are applied in practice. Often Congress only gives a broad out line of what is to be done.
Now Celerian Group, subsidiary of South Carolina Blue Cross Blue Shield.; the claims payer for Medicare , under CEO Blodgett info control , has refused to issue me a decision for over two years also. All I can do is follow up and remind them and be treated pretty badly for even reminding them they are violating my rights and breaking their contract with CMS to uphold the laws of the land.. It would be a denial for current reg does not permit it without a supplier and they refuse to do so that I can send it on up to associate with the pending hearings I even spoke to their management nearly a year ago and they agreed that I had filed things correctly to get an answer. But no answer to date. So 90 days, is far less than years and rebuffs to have rights. PATIENTS HAVE THE SAME RIGHTS EVERY OTHER PARTY DOES IN THIS AS ITS OUR LIVES AND OUR FINANCIAL RISK AT STAKE ALSO.
Patients have died in the USA over this re source and others badly harmed. In my case Medicare judges said the bill is FECA's but CEO Blodgett has total control of that since 2002 and have formed more companies to add to his over a 100 and nearly every worker in the USA is now become his 'slave for life if injured on the job and right to live gone' as insurers are just contracting out to him and do not wish to know the horrors that occur. Yet a congressional study nearly a decade ago indicated how bad it was, IF ANY ONE CARED TO KNOW. OR TAKE CONGRESSIONAL ACTION TO HELP.
And the political pundits and those in their ivory towers in DC wonder why outsiders are getting votes this year? WE, THE PEOPLE HAVE HAD ENOUGH OF A REAL STRUGGLE FOR SURVIVAL AND NO GOVERNMENT IN CHARGE OF DEALING WITH REAL CRIMINALS STEALING FROM THE PUBLIC TREASURY AND DENIAL OF ALL OF OUR RIGHTS AS NO ONE IN CHARGE TO MAKE SURE WE HAVE THEM AND CONGRESSES HAVE DINE NO FUNDING TO STOP THESE ATROCITIES SINCE 2002 AND WILL NOT SPEAK OF IT AS IF ASHAMED OF WHAT THEY HAVE DONE AND ARE DOING.
To Be Fair: Some do care and have tried and been shunned aside.
Some elected since then have been lied to and kept in the dark, it seems. AND DO NOT KNOW OF WHAT IS GOING ON UNDER THEIR OWN NOSES THEY HAVE RESPONSIBILITY TO OVER SEE AND HAVE SHIRKED THEIR DUTY TO THE PEOPLE BY BEING KEPT IGNORANT OF ALL. .
But to buck the system may be the only hope for all of us. As this may not go on for this nation to survive. I PRAY THAT THOSE IN OFFICE AND WHO WILL BE PLACED IN OFFICE NEST YEAR, STAND UP FOR THE US AND THE USA. for in doing so, the world will benefit also as this is an international cabal that has grabbed control from us. And we and I have only been dealing with the visible 'little horn' of a beast system who is replaceable by this 'beast' system that is a maze that took decades to put in place to control all. I pray for Lynn Blodgett and his brothers, that hey will 'blow the whistle ' on what they know. Salvation is open to all , is my faith. And one may lose their earthly wealth, but gain eternal life.
