I do support those organized and responsible groups who have volunteered to help patrol the borders as it needs to be done. And I sympathize with those coming who are truly in danger and in need of help. But anyone can come in if due diligence to our national security is not done. For those who have decided to trespass into the USA, there is a need to have a due process general sorting of reasons and do what needs to be done for humane purposes. Those who should not have come do need to be asked to go home and we need further investigation as to what is really going on in Central America and whether our govt has had any hand in causing the out of control and dangerous situation. We have some parts of this nation that are 'dangerous' , too and that needs to be addressed.
CONDOLENCES TO CARMEN CHILSON'S FAMILY ON THE RESURRECTION OF HER DAD TO HEAVEN.
This is a medical tragedy that should never have occurred in this manner and is being repeated too often under a broken health care system where love and healing have been squashed by profit margins and unaccountable govt contractors running health care from one part to another and all in between. Carmen joined with others on Face book over a year ago researching the full bio of President Obama and helped greatly in doing research for info I did not have access to even though I was an eyewitness to the circumstances of his birth in Topeka , Ks.
I have been greatly blessed by many face book friends who have been a spiritual inspiration to many and to me in some very trying times which are not over for us.
Doyle and I spent most of the day filing papers and appeals. Much of the info in them is personal in nature and includes SSN's etc., so did not post the 11 page letter written. but it is summed up in Violations of Civil Rights Page 46. posted here and on other of my sites.
Anyone with a Federal health benefits plan like Blue Cross / Blues Shield and a Part D Medicare prescription drug plan has not been given in writing what their coverage is and we have had all kinds of misinformation given and some decided to not take part D not being aware that it was to work like Part A and B of Medicare and all be paid. THIS HAS BEEN KEPT SECRET FORM US SINCE 2005 WHEN WE FIRST GOT OUR BLUES CONTRACT BOOKLET FOR THE YEAR AND WAS INFORMED THAT A COORDINATION PLAN EXISTED. WE HAVE TIRED FOR 8 YEARS TO FIND OUT WHAT IT IS AND FILED COMPLAINTS AND WRITTEN LETTERS, ETC. SO THE CASE HAS BEEN MADE AND CURRENT TO ASK FOR ALL THE CO PAYS WE HAVE BEEN FORCED TO PAY BE REFUNDED.
ITS NOT ABOUT JUST THE MONEY, which we could use badly. ITS ABOUT THE LACK OF REGARD FOR THE CONSTITUTIONAL RIGHTS OF WE FEDS AND NOW EVERYONE GETS TO BE UNDER THIS UNCONSTITUTIONAL HEALTH PLAN FOR ALL AND IT IS FOR ALL THROUGH REGULATIONS AND PROVISIONS THAT COVER EVERYONE, NOW. THAT IS NO MATTER WHAT KIND OF INSURANCE OR NO INSURANCE ONE MIGHT HAVE.
Healing and caring for one another seems to be lost in all of this.
This is which ever is the primary and whether the subscriber of the federal health plan is retired or not. Many do get special assistance through a form of state Medicaid that I still do not fully understand and that is being ripped off , too. When those without, need every precious dollar for their care. This year, we finally found out as we pay $0 at the pharmacy now. For 8 years all we Feds have been 'had.' Even those selling the Part D Medicare prescription drug plans had no info to tell us as to what the coverage was . All we ever got was there is a coordination plan but it was secret from everyone directly involved fro the patient to the pharmacy to those selling the plans. And no one at OPM knew either. The only ones who knew and not obeying it was the govt contractors running it?.
On top of that is the fiasco where ACS-Xerox management in their North Carolina facility? has been the claims payer for all the insurers? and nothing has ever been sent to recovery to get reimbursement when Medicare had to pay and the bill was legally another health care plan or insurer.
Since there is no internal audits of a govt contractor, those processing the claims did not know they were to do so. I merely did what any trained auditor would do and find out if all the rules and laws and constitutional rights of all were being upheld. A govt audit is not just abut the money. I believe them, as this is the way secret deals survive. Good and capable people are hired and not trained to know and they think they are doing what they are suppose to.
Some are now aware, but nothing has changed as nothing has been sent to recovery on our claims where Part D Medicare is secondary to a primary. For me its Federal workers comp but for the others on my Federal health plan, that will be their primary until ACS-Xerox obeys the Judges an posts, process and pays and the last remand orders was I a was to be asked or the facts as everyone else seems to be using gossip, rumor and misinformation to base decisions on. A few are intentionally lying as has been written about here and documented. \
My coverage all hinges on those over a decade of timely filed oxygen claims ACS will not input " BECAUSE THEY WOULD BE PAID AND THE 'GIG' WOULD BE UP AND WE WOULD HAVE TO PAY ALL OF YOUR BILLS. " was the exact quote from their manager as she followed orders to " Let her die." another direct quote and one of multiple who said that was the order on me.
Exactly what the law says is to occur when one has permanent medical benefits. And THAT IS A SEPARATE ISSUE From ANY WAGE LOSS OR INCOME CHECKS, ETC. or even working.
HCS Holdings, Inc., the owner of our local Blues, sent me a letter and it appears they had called the govt contractor call center, again; which gets their info from ACS and not from any official source. And asked them to locate a non existent retirement date . This is the call center for OPM. Over the years, a change of address , a cost of living, and now and another personnel action that has nothing to do with a retirement date has been found on the govt contractor's computer screen and turned into that non existent retirement date. Federal workers cop law is not well known and has many provisions.
This is putting our lives in jeopardy in trying to get medical care and myself not being able to get the one liquid oxygen supplier in the area. Another leak occurred in the tank we take to the gas company and more glue and gorilla tape was applied, but this impasse has to cease and we are begging those who get our filings please understand they are very serious life and death matters.
All who think they know the laws, etc. need to stop asking Emblem Health International which owns the Common Working File all access to bill insurers and Medicare to violate their govt contracts by having them alter the official info that posts from the US Dept of Labor on us. They are not to alter postings from govt agencies and employers.
We did what legally needed to be done and filed appeals on the alterations and the lower Medicare judges and the appellate Medicare judge ruled on M09-1406 it is accurate and no change in status since then. And affirmed my life time approval by Medicare for liquid oxygen, but that it was federal worker's comp bill and the monies need to be recovered from that program. That means an oxygen supplier has to bill them fist and wait 4 months to not get an answer before billing fed blues and then be instructed to have Medicare pay. For months one can be receiving medical care and the supplier not getting any money. It means, as I found out. with in a hundred miles of me; no one with a Medicare card and any form of workers comp can get oxygen even the concentrator kind. NO RIGHT TO BREATHE AND IF THAT IS NOT A REAL DEATH PANEL WHAT IS? ACS IS NOW TAKING OVER MOST STATE WORKERS COMP. FOLLOWING THEIR GREAT SUCCESS WITH US FEDS OF REDUCING COSTS BY LETTING MEDICARE PAY THE BILLS OR NOT PAYING AT ALL..... AND PREMATURE DEATHS CAN OCCUR.
The appellate judges have ruled at Medicare on M09-1406 and US Dept. of Labor and I personally verified that the real records at OPM show active duty status and workers comp jurisdiction several years ago when all of those using misinformation almost had me convinced. The former acting director of OPM and general counsel pulled up my real records and set me straight and said "DON'T FORGET THAT THE FEDERAL WORKERS COMP LAW OVERRIDES EVERYTHING FOR YOU AND YOU CANNOT RETIRE UNTIL THEY GET YOU ON PERMANENT DISABILITY. SHE EVEN HAD MY SIGNED AGREEMENT WITH MY EMPLOYING AGENCY. " A later Director of OPM started to try and find out why all this was occurring but resigned to go to private industry and no further investigation has occurred, I am aware of. I have been told they suspect an embezzlement ring operating and But no director has allowed the OIG for OPM to spend any money to investigate. JUST HOW MUCH OF THE PUBLIC MONIES AND LIVES AND HEALTH AND LIVELIHOODS HAVE TO BE LOST BEFORE ITS COST EFFECTIVE TO INVESTIGATE?
Why should there be all this secrecy from all those involved as they should have a right to the information to make legal and proper decisions.
One of the Asst. US Attorney's I have spoken to over the last few years has said what is occurring is "conspiracy to defraud Medicare."
HR 1063 IS THE NEW LAW THAT WILL STOP ALL OF THIS SKULDUGGERY AND WE ARE ASKING IT BE USED TO ENFORCE THE LAW IN OUR CASE. Government officials and government contractors are not excluded from fines an penalties under it. It empowers govt officials to enforce the US Dept of labor judges and laws to reconstruct my file from my records, process and pay. That is not interfering with the merits of an established case at all. But it does cease Medicare paying the bills that are not its to pay just because Medicare has a good and generous conditional payment law in it so that bills can be paid so patients can get medical care in spite of what their primaries are doing or being led to do by those who are not permitting it to occur for whatever motivation they might have.
So am very tired and will spell check and edit and try and get some rest.
